COMPLIANCE FOR EMPLOYERS IN THE HAIR & BEAUTY INDUSTRY

As we prepare for 2025, employers in the hairdressing and beauty industry are encouraged to boldly take charge of their compliance responsibilities. Compliance need not be intimidating—when broken into manageable steps, it becomes an empowering process that strengthens your business and safeguards its future.

What is Legislative Compliance?

Legislative compliance refers to ensuring that your business operates within the laws, regulations, and standards set by governmental and regulatory bodies. In the hair and beauty industry, this includes adhering to industry-specific requirements such as health and safety, labour laws, and BBBEE standards.

The Five Pillars of Legislative Compliance

  1. Understanding Legal Requirements: Identify and interpret the laws and regulations applicable to your business.

  2. Implementation: Develop policies, procedures, and practices that ensure adherence to these legal requirements.

  3. Monitoring and Auditing: Regularly review and audit your practices to ensure you remain compliant.

  4. Training and Awareness: Educate your employees and stakeholders about their roles in maintaining compliance.

  5. Reporting and Documentation: Keep accurate records and submit reports to regulatory bodies as required.

Step-by-Step Guide to Compliance

To make compliance manageable, consider the following approach:

  1. Obtain and review the Main Collective Agreement Begin by reviewing the Main Collective Agreement from the National Bargaining Council for the Hairdressing and Beauty Industry. While this document can be complex, your EOHCB representative is there to guide you through it. Once you have clarity, you’ll find that other compliance areas, such as health and safety, naturally fall into place.

  1. Create a Compliance Checklist to identify specific compliance requirements for 2025. Compile these into a checklist, including:

  • Labour law compliance

  • Health and safety protocols

  • BBBEE requirements

Tick off items as you complete them, and for those outstanding, make a note to address them early.

  1. Seek Professional Assistance as you don’t have to navigate compliance alone. EOHCB consultants can provide expert advice, helping you avoid missteps and ensuring you meet all requirements.

  1. Plan for the Long Term Begin your preparations now. Being ready not only reduces stress but also ensures that any inspections or engagements with regulatory bodies, such as the Department of Labour, are smooth and professional.
